The Basketball Lab Terms and Conditions

The Basketball Lab Pty Ltd and The Basketball Lab Underwood Pty Ltd (“we,” “us,” “our,” “The Basketball Lab,” “the Lab,” or “the facility”) is governed by these Terms & Conditions, Lab Rules, Activity Waiver Form, and any other agreements signed upon entering The Lab. The Basketball Lab Pty Ltd reserves the right to address breaches and enforce necessary consequences. The Basketball Lab Pty Ltd also reserves the right to amend any terms, agreements, or waivers, with notification provided to members upon implementation. Members wishing to consult, inquire, or appeal any terms or Lab rules should contact The Basketball Lab Pty Ltd at info@thebasketballlab.net. Any claim made contrary to these Terms and Conditions shall be subject to the rights, releases and limitations contained within this agreement to the maximum extent permitted by law.  By entering The Basketball Lab Pty Ltd facility, all individuals implicitly accept these terms and conditions.

1. Facility Entry

  • 1.1 Location:
    West End: Unit 4, 208 Montague Road, West End, QLD, 4101.
    Underwood: Unit 4, 1 Graham Street, Underwood, QLD 4119.

  • 1.2 Membership Access: Only current and active membership holders may enter the facility. 

  • 1.3 Minimum Age Requirement: Individuals under 18 require permission from an adult to sign up. Legal guardians (18+) must be present in person when an underage member collects their access tag and undergoes membership induction. Members aged 13-17 may access the facility 24/7 with the permission of their guardian, people aged 12 and younger must always be supervised by their legal guardian.. 

  • 1.4 Door Security: Members must close doors upon entry and exit. Failure to do so, resulting in unauthorized entry or property damage, will incur penalties.

  • 1.5 Casual Entries: Casual entries are 5pm - 9pm weekdays (unless otherwise specified on our website) only, if you have friends or family who are not members you cannot bring them into the facility outside staffed hours, this will be deemed as tailgating and the relevant fines will apply.

  • 1.6 Entry Etiquette
    For security reasons, every member must enter the facility using their own access tag or approved access credentials.Members must not:

  • Hold doors open for others.

  • Allow another person to enter behind them.

  • Enter without scanning their own access tag.

  • Use another member’s access credentials.

The door must fully close after each person enters before the next individual unlocks the door using their own access credentials.

Failure to follow the correct entry procedure may be deemed tailgating and may result in fines, suspension or cancellation of membership.

  • 1.7 Tailgating Includes: 

    • Allowing a non-member to enter the facility.

    • Allowing another member to enter without scanning their own access tag.

    • Opening the door and holding it open for others to enter.

    • Allowing entry through any method that bypasses the Basketball Lab access system.

2. Membership Terms

  • 2.1 Start Date: Memberships begin on the specified start date, with awareness of upfront costs and additional fees, and membership sales. 

  • 2.2 Direct Debit & Ongoing Memberships: By signing these terms and conditions, you consent and understand memberships are direct debit, furthermore, memberships are ongoing and are not for a fixed period. Memberships continue beyond the minimum commitment period (Initial Term) and only end if the member provides written cancellation notice to cancellation@thebasketballlab.net.

  • 2.3 Cooling-off Period: Members have 48 hours to cancel after signing their agreement. Cancellations within this period require written notice.

  • 2.4 Commitment Period: Members agree to fulfill payment obligations throughout the commitment period.

  • 2.5 Membership Commitments: Memberships are legally binding lock-in contracts. By signing these terms, you acknowledge and agree to fulfill the entirety of the contractual period. Additionally, you confirm that you have the financial capacity to honor this contract in full.

  • 2.6 Membership Freeze: Members may pause their membership for up to 30 days for valid reasons like injury or vacation.

  • 2.7 Freeze Longer Than 30 Days: Any freeze request longer than 30 days due to injury must be substantiated with a medical certificate. The Basketball Lab will provide a template for this certificate through email.

  • 2.8 Non-transferable Memberships: Memberships are strictly personal and cannot be shared or transferred.

  • 2.9 Communication: All general enquiries must be sent to info@thebasketballlab.net, The Lab takes no responsibility for any missed communication sent to other email addresses, or other communication methods. 

  • 2.10 Access Tag Collection: Membership is deemed active upon the completion of the sign-up process, which includes signing the terms and conditions and providing a valid payment method. Members accept and agree that they have access to the services provided by The Basketball Lab upon activation of their membership. It is the responsibility of the member to collect their access tag or to contact The Basketball Lab to arrange a suitable time or alternative solution for its collection. Failure to collect the access tag does not relieve the member of their financial obligations, as membership fees will continue to apply once the payment method has been added. By agreeing to these terms and conditions, the member acknowledges and accepts their responsibility for managing access to the facility and ensuring the collection of their access tag.

  • 2.11 Membership Sales: Any sale that The Basketball Lab runs, such as introductory offers or promotional periods, is not included in the membership commitment period. The commitment period will begin after the sale period ends. For example, if a 12-month minimum commitment is chosen and the first 4 weeks are free, the 4 weeks free does not count towards the minimum commitment period. 

  • 2.12 Change of Payment Method
    Members must maintain a valid payment method at all times. If a payment method expires, is cancelled, replaced, locked or otherwise becomes inactive, the member remains responsible for immediately updating their payment details. Failure to maintain a valid payment method does not suspend payment obligations.

3. Payment & Fines

  • 3.1 Payment Schedule: West End payments are processed fortnightly on Thursdays, Underwood payments are processed weekly on a Thursday. 

  • 3.2 Tailgating: Unauthorized access ("tailgating") incurs a fine of $150 per unauthorized individual.

  • 3.3 Activation Fees: Initial sign-up fees are required upfront and are non-refundable.

  • 3.4 Recurring Payments: Payments are due for the full billing cycle even if the membership is canceled, frozen, or suspended during that period. Late or missed payments incur fines.

  • 3.5 Rejected Payments: A $10 fee applies for failed payments. After two missed payments, debt collection may be pursued.

  • 3.5A Access Restriction for Overdue Accounts
    If a scheduled payment remains unpaid for more than twenty-four (24) hours after the due date, The Basketball Lab reserves the right to immediately suspend and restrict the member’s access to all Basketball Lab facilities, services and membership benefits.  Access will remain restricted until all outstanding membership fees, failed payment fees and other outstanding charges have been paid in full.  Suspension of access does not cancel the membership or remove any payment obligations under these Terms and Conditions.

  • 3.5B Direct Debit Processing Fees
    The Basketball Lab utilises third-party payment providers to process membership payments.  Membership payments processed via direct debit may incur a transaction or processing fee charged by the payment provider.  The Basketball Lab absorbs and pays any applicable GST associated with its services; however, members acknowledge and agree that they are responsible for any transaction, merchant or processing fees charged by the payment provider.  By signing these Terms and Conditions and providing a payment method, members acknowledge and consent to such fees being charged in addition to their membership fees.

  • 3.6 Inappropriate Conduct: Any inappropriate, disrespectful, or irresponsible use of the facility will result in a $50 fine.

4. Membership Fees & Changes

  • 4.1 Access Fob: Lost fobs can be replaced for $30.

  • 4.2 Upgrades & Downgrades: Membership upgrades are free. Downgrades require 30 days’ notice.

  • 4.3 Fee Adjustments: The Lab may adjust fees with notice; members can cancel within 14 days if rates increase.

5. Cancellations

  • 5.1 6 & 12 Month Early Cancellations: Allowed under specific conditions, such as permanent illness, injury, bankruptcy, or relocation. Cancellations require a $250 fee, payment of outstanding dues, one month’s notice, and either return or $30 compensation for their access tag.  Failure to use the facility, attendance levels, change of sporting interests, school commitments, work commitments, financial circumstances, scheduling conflicts, dissatisfaction with services or personal preference do not constitute grounds for early cancellation.

  • 5.2 Early Cancellation Acceptance: Early cancellation requests will not be accepted unless they meet the specified criteria and are supported by evidence that The Basketball Lab deems sufficient. If these criteria are not met, you are required to fulfill your entire minimum commitment period. By signing these terms and conditions, you acknowledge that you have read, understood, and agree to this clause. 

  • 5.3 Facility Closure: If the Lab closes for more than 30 days for any reasons other than natural disasters members may cancel.

  • 5.4 Cancellation Notice: All cancellations require a 30-day notice, effective from the date the notice is sent to cancellation@thebasketballlab.net. Any and all other forms of cancellation notice will not be accepted and will not start the 30-day notice period. Cancellation requests submitted via phone call, text message, social media, verbal conversation, coach communication or any email address other than cancellation@thebasketballlab.net will not be accepted and will not commence the 30-day cancellation notice period. Furthermore, early cancellation 30 days notice will not commence until The Basketball Lab has received and verified supporting documentation.

  • 5.5 Freeze: Members cannot use the membership freeze option during the 30-day cancellation notice period.

  • 5.6 Injury or Medical Condition: Cancellations due to injury or medical conditions require documentation from a medical provider on a template that The Basketball Lab will provide.

  • 5.7 Relocation: If the member relocates, proof of relocation must be provided through adequate documentation. The Basketball Lab has the discretion to determine what locations and distances are considered inaccessible to the facility.

  • 5.8 The Basketball Lab Cancellation: The Basketball Lab reserves the right to cancel any membership for any reason it deems necessary and adequate.

  • 5.9 18 & 24 Month Early Cancellations:
    Memberships with an 18-month minimum commitment are subject to the following terms:
    The early cancellation fee is calculated at 50% of the remaining membership fees      due under the contract at the time of cancellation.
    This fee is payable in person after 30 days notice has finished.
    The membership agreement will remain active and enforceable until the early cancellation fee, final payment, notice period fees and any outstanding charges have been paid in full.  Any recurring membership fees that fall due prior to payment of the early cancellation fee remain payable and are not deducted from the early cancellation fee.

6. Health and Safety

  • 6.1 Health Risks: Members should consult a medical professional if health risks are a concern and notify the Lab in writing.

  • 6.2 Equipment Use: Use of all equipment is at the member’s risk, with staff available for assistance on operation.

  • 6.3 Prohibited Activities: For safety, sleeping, swinging, dunking, and hanging on rings are strictly prohibited.

  • 6.4 First Aid: You give The Basketball Lab permission for staff to administer first aid in case of injury or emergency.

  • 6.5 Facility Conditions: The Basketball Lab is not air-conditioned and may become hot during certain times of the year, the facility courts may also become slippery at times due to bad weather and or humidity. While The Lab takes steps to minimize the impact of these factors by entering the facility, you accept this risk and release The Basketball Lab Pty Ltd and The Basketball Lab Underwood Pty Ltd from any claim, loss, damage or liability arising from such conditions to the maximum extent permitted by law.

  • 6.6 Underage Use of Equipment: Members under the age of 15 are not permitted to use the gym equipment for any reason.

  • 6.7 Barbell Bench Press: Members are not permitted to perform the barbell bench press in the facility. By signing these terms and conditions, members acknowledge they do so entirely at their own risk and release The Basketball Lab Pty Ltd and The Basketball Lab Underwood Pty Ltd from any claim, loss, damage or liability arising from a breach of this rule to the maximum extent permitted by law.

7. Liability

  • 7.1 Assumed Risks: The Lab is not liable for injuries or death unless due to gross negligence.

8. Facility Rules 

  • 8.1 Booking Requirements: Members must pre-book training sessions online; walk-ins are not allowed.

  • 8.2 Behavior Standards: Physical violence, bullying, and inappropriate language are prohibited and may result in suspension or cancellation.

  • 8.3 Substance Use Policy: The use, possession, or entry under the influence of illegal substances, alcohol, or smoking is prohibited. Prescription medication exceptions require documentation.

  • 8.4 Use of Facility: Members must use the facility responsibly and respectfully.

  • 8.5 Inappropriate Conduct: Any inappropriate, disrespectful, or irresponsible use of the facility will result in a $50 fine.

  • 8.6 Examples of Violations: Includes but is not limited to causing disruptions, damaging property, engaging in unsafe activities, leaving rubbish, leaving gym equipment in unsafe and wrong places or disturbing other members' experiences.

9. Privacy & Photography

  • 9.1 Photo/Video Consent: By signing, members consent to be photographed or filmed for Lab use on various platforms.

  • 9.2 CCTV & Security Monitoring
    Basketball Lab facilities may be monitored by CCTV, access control systems and other security measures.  By entering the facility, members consent to the collection and use of CCTV footage, access records and security data for operational, disciplinary, investigative, debt recovery, security and legal purposes.  The Basketball Lab may use such records when investigating breaches of these Terms and Conditions.

  • 9.3 Law Enforcement Cooperation: The Lab may cooperate with authorities for investigation purposes.

10. Parent & Legal Guardian 

  • 10.1 If an adult enters the facility without a membership to supervise a member, it is strictly for supervision purposes only. The adult must not participate in any physical activity. Examples include, but are not limited to:

    • Rebounding

    • Playing one-on-one

    • Playing defense

    • Shooting

  • 10.2 If the supervising adult violates these rules:

    • The member’s account will be suspended.

    • A $150 fine for "theft of service" and “tailgating” will be charged to the member's account.

    • If the adult injures themselves while engaging in prohibited activities, they acknowledge they have acted contrary to these Terms and Conditions and release The Basketball Lab Pty Ltd and The Basketball Lab Underwood Pty Ltd from any claim to the maximum extent permitted by law.

  • 10.3 Underaged Member: Underaged members are not permitted to collect their access tag unless a parent or guardian is present at the facility. The parent or guardian will also be required to complete a Parental Guarantor Form. By signing this form, the parent or guardian accepts full responsibility for the membership contract and payment obligations, even if the underaged member completed the sign-up process. By signing, you confirm that the sign-up was completed with your consent, knowledge, and approval, and this document along with the Parental Guarantor Form serves as confirmation of that agreement.

11. Member Lounge Rules

  • 11.1 Restricted Access: Only members are permitted in the lounge. Sexual conduct or inappropriate behaviour may result in immediate cancellation and fines.

12. Debt Collection

  • 12.1 Overdue Payments: The Basketball Lab will notify you of overdue payments as frequently as it deems necessary.

  • 12.2 Third-Party Debt Collection: After 60 consecutive days of missed payments, the outstanding debt will be transferred to a third-party collection agency. By signing these terms and conditions, you consent to The Basketball Lab’s right to refer your debt to collections. At this point, your membership will be cancelled, incurring a $250 early cancellation fee (if applicable), along with a 30-day notice period charge, and $30 charge for replacing your access tag. 

  • 12.3 Responsibility for Fees: All additional fees and charges associated with debt collection will be your responsibility. You will not be permitted to rejoin The Basketball Lab until the remaining debt is paid in full.

  • 12.4 Cancellation 
    Cancellation of a membership does not remove any outstanding debt, fees, fines, charges or obligations owed to The Basketball Lab.

13. Damages

  • 13.1 Responsibility for Damages: Any and all damages caused by an individual using the facility will be the responsibility of the membership holder or guardian. By signing these terms and conditions, you consent to covering all costs associated with damages incurred.

14. Basketball Lab Training Sessions 

14.1 The Basketball Lab does not allow external coaching sessions. All sessions inside The Basketball Lab must be under the guidance of a coach authorized by The Basketball Lab. 
14.2 Bringing your own personal coach into the facility is considered theft of service and will be deemed tailgating.
14.3 Members cannot coach other members for financial gain. If this is performed, The Basketball Lab will seek any and all costs paid for the sessions.
14.4 Theft of service includes any attempt to access Basketball Lab facilities, coaching, equipment, membership benefits or services without the required membership, payment or approval from The Basketball Lab.

15. Facility Availability

15.1
The Basketball Lab reserves the right to restrict access to the facility or parts of it at any time for any reason, including but not limited to:

  • Events

  • Cleaning

  • Renovations

  • Maintenance

  • Repairs

You also acknowledge and consent that certain services, such as training sessions, shooting lanes, or court space, may occasionally be unavailable or may incur additional fees. Members are advised to check availability and pre-book services where applicable.

16. Parental Guardian Consent

This section applies if the membership is signed on behalf of a minor, or a minor has completed the sign up process themselves with your consent.

16.1 By signing these terms and conditions or parental guarantor form, you confirm that you are over the age of 18, you are either the legal parent or guardian of the membership holder, and take full responsibility for membership payments while agreeing to the following:

  • Payment Responsibility: You accept responsibility for all payments associated with the membership.

  • 24/7 Facility Access Consent: You give permission for the membership holder to access The Basketball Lab facilities 24/7.

  • Supervision Requirements:

    • Members aged 12 and under must always be supervised by you or another designated adult.

    • Members aged 13 to 16 may access the facility independently but may bring a parent or guardian for supervision purposes only, limited to providing guidance without participating.

16.2 By signing, you acknowledge and accept these responsibilities and confirm that you are aware of the supervision requirements based on the age of the membership holder.

16.3 You acknowledge that you were given adequate and sufficient time to review the terms and conditions before completing the sign-up process, whether done by you or someone else with your knowledge. By proceeding, you agree to all the terms and conditions outlined in the contract. If you chose not to review the terms and conditions, that is your own responsibility, and no one else is liable or accountable for this decision. 

17. Grandfathered & Legacy Membership Benefits

The Basketball Lab reserves the right to modify, replace or discontinue membership structures, pricing and benefits at any time.

Members who held a legacy membership prior to the introduction of new membership structures may retain their existing pricing and benefits under a grandfathered arrangement, provided:

  • Their membership remains active.

  • Their account remains in good standing.

  • Their membership is not cancelled or transferred.

Effective 1 August 2026, Basic, Bronze, Premium and Gold memberships are no longer available to new members.

Eligible grandfathered members may continue to receive their existing benefits, including Universal Access and other applicable inclusions.

The “Bring A Kid Free” benefit is only available to members who held an eligible Gold or Premium membership prior to 1 January 2026. The child must be 12 years of age or younger. Once the child turns 13, they must obtain their own membership to continue using the facility.

Grandfathered benefits are personal, non-transferable and may be removed if the membership is cancelled, terminated or otherwise becomes ineligible.

The Basketball Lab reserves the right to introduce new membership structures, pricing and benefits which may differ from grandfathered memberships.

18. Third-Party Provider Consent Form & Direct Debit Authorization

18.1 Third-Party Provider
The Basketball Lab works with third-party providers to deliver essential services to members. These services may charge a small transaction/processing fee. By signing these terms and conditions, you understand this and consent to the following:

  • Personal Information Storage: You authorize Perfect Gym, our gym management software provider, to securely store your personal information according to their data privacy policies.

  • Payment Processing: You give permission for Payrix, our payment processing provider, to withdraw membership payments from your nominated payment method as required under The Basketball Lab’s membership payment schedule and policies.

  • Direct Debit Authorization: You authorize The Basketball Lab to withdraw all applicable membership payments, fines, and other fees directly from your nominated personal payment method in accordance with The Basketball Lab’s policies.

18.2 Signature
Your signature on these terms confirms your consent to the use of these third-party services and the authorization of direct debit transactions as outlined above.

18.3 Electronic Acceptance

By signing these Terms and Conditions, ticking the Terms and Conditions acceptance box during the sign-up process, submitting a membership application, providing payment details, completing an online registration form or accessing Basketball Lab facilities, services or memberships, the member acknowledges and agrees that they have read, understood and accepted these Terms and Conditions and agree to be legally bound by them.

Electronic acceptance, digital acknowledgement, online acceptance and acceptance through a membership platform carry the same legal force and effect as a handwritten signature.

Where the membership holder is under eighteen (18) years of age, the parent or guardian acknowledges that they have reviewed these Terms and Conditions, consent to the membership and accept responsibility for all obligations, fees, charges and liabilities arising from the membership and will be required to sign a parental guarantor form.

18.4 Failure to Read
The member acknowledges that they have been provided adequate opportunity to review these Terms and Conditions prior to completing the sign-up process. Failure to read these Terms and Conditions does not remove any obligation arising under this agreement.

If a payment method expires, is cancelled, replaced, locked or otherwise becomes inactive, the member remains responsible for immediately updating their payment details. Failure to maintain a valid payment method does not suspend payment obligations.

3. Payment & Fines

  • 3.1 Payment Schedule: West End payments are processed fortnightly on Thursdays, Underwood payments are processed weekly on a Thursday. 

  • 3.2 Tailgating: Unauthorized access ("tailgating") incurs a fine of $150 per unauthorized individual.

  • 3.3 Activation Fees: Initial sign-up fees are required upfront and are non-refundable.

  • 3.4 Recurring Payments: Payments are due for the full billing cycle even if the membership is canceled, frozen, or suspended during that period. Late or missed payments incur fines.

  • 3.5 Rejected Payments: A $10 fee applies for failed payments. After two missed payments, debt collection may be pursued.

  • 3.5A Access Restriction for Overdue Accounts
    If a scheduled payment remains unpaid for more than twenty-four (24) hours after the due date, The Basketball Lab reserves the right to immediately suspend and restrict the member’s access to all Basketball Lab facilities, services and membership benefits.  Access will remain restricted until all outstanding membership fees, failed payment fees and other outstanding charges have been paid in full.  Suspension of access does not cancel the membership or remove any payment obligations under these Terms and Conditions.

  • 3.5B Direct Debit Processing Fees
    The Basketball Lab utilises third-party payment providers to process membership payments.  Membership payments processed via direct debit may incur a transaction or processing fee charged by the payment provider.  The Basketball Lab absorbs and pays any applicable GST associated with its services; however, members acknowledge and agree that they are responsible for any transaction, merchant or processing fees charged by the payment provider.  By signing these Terms and Conditions and providing a payment method, members acknowledge and consent to such fees being charged in addition to their membership fees.

  • 3.6 Inappropriate Conduct: Any inappropriate, disrespectful, or irresponsible use of the facility will result in a $50 fine.

4. Membership Fees & Changes

  • 4.1 Access Fob: Lost fobs can be replaced for $30.

  • 4.2 Upgrades & Downgrades: Membership upgrades are free. Downgrades require 30 days’ notice.

  • 4.3 Fee Adjustments: The Lab may adjust fees with notice; members can cancel within 14 days if rates increase.

5. Cancellations

  • 5.1 6 & 12 Month Early Cancellations: Allowed under specific conditions, such as permanent illness, injury, bankruptcy, or relocation. Cancellations require a $250 fee, payment of outstanding dues, one month’s notice, and either return or $30 compensation for their access tag.  Failure to use the facility, attendance levels, change of sporting interests, school commitments, work commitments, financial circumstances, scheduling conflicts, dissatisfaction with services or personal preference do not constitute grounds for early cancellation.

  • 5.2 Early Cancellation Acceptance: Early cancellation requests will not be accepted unless they meet the specified criteria and are supported by evidence that The Basketball Lab deems sufficient. If these criteria are not met, you are required to fulfill your entire minimum commitment period. By signing these terms and conditions, you acknowledge that you have read, understood, and agree to this clause. 

  • 5.3 Facility Closure: If the Lab closes for more than 30 days for any reasons other than natural disasters members may cancel.

  • 5.4 Cancellation Notice: All cancellations require a 30-day notice, effective from the date the notice is sent to cancellation@thebasketballlab.net. Any and all other forms of cancellation notice will not be accepted and will not start the 30-day notice period. Cancellation requests submitted via phone call, text message, social media, verbal conversation, coach communication or any email address other than cancellation@thebasketballlab.net will not be accepted and will not commence the 30-day cancellation notice period. Furthermore, early cancellation 30 days notice will not commence until The Basketball Lab has received and verified supporting documentation.

  • 5.5 Freeze: Members cannot use the membership freeze option during the 30-day cancellation notice period.

  • 5.6 Injury or Medical Condition: Cancellations due to injury or medical conditions require documentation from a medical provider on a template that The Basketball Lab will provide.

  • 5.7 Relocation: If the member relocates, proof of relocation must be provided through adequate documentation. The Basketball Lab has the discretion to determine what locations and distances are considered inaccessible to the facility.

  • 5.8 The Basketball Lab Cancellation: The Basketball Lab reserves the right to cancel any membership for any reason it deems necessary and adequate.

  • 5.9 18 & 24 Month Early Cancellations:
    Memberships with an 18-month minimum commitment are subject to the following terms:
    The early cancellation fee is calculated at 50% of the remaining membership fees      due under the contract at the time of cancellation.
    This fee is payable in person after 30 days notice has finished.
    The membership agreement will remain active and enforceable until the early cancellation fee, final payment, notice period fees and any outstanding charges have been paid in full.  Any recurring membership fees that fall due prior to payment of the early cancellation fee remain payable and are not deducted from the early cancellation fee.

6. Health and Safety

  • 6.1 Health Risks: Members should consult a medical professional if health risks are a concern and notify the Lab in writing.

  • 6.2 Equipment Use: Use of all equipment is at the member’s risk, with staff available for assistance on operation.

  • 6.3 Prohibited Activities: For safety, sleeping, swinging, dunking, and hanging on rings are strictly prohibited.

  • 6.4 First Aid: You give The Basketball Lab permission for staff to administer first aid in case of injury or emergency.

  • 6.5 Facility Conditions: The Basketball Lab is not air-conditioned and may become hot during certain times of the year, the facility courts may also become slippery at times due to bad weather and or humidity. While The Lab takes steps to minimize the impact of these factors by entering the facility, you accept this risk and release The Basketball Lab Pty Ltd and The Basketball Lab Underwood Pty Ltd from any claim, loss, damage or liability arising from such conditions to the maximum extent permitted by law.

  • 6.6 Underage Use of Equipment: Members under the age of 15 are not permitted to use the gym equipment for any reason.

  • 6.7 Barbell Bench Press: Members are not permitted to perform the barbell bench press in the facility. By signing these terms and conditions, members acknowledge they do so entirely at their own risk and release The Basketball Lab Pty Ltd and The Basketball Lab Underwood Pty Ltd from any claim, loss, damage or liability arising from a breach of this rule to the maximum extent permitted by law.

7. Liability

  • 7.1 Assumed Risks: The Lab is not liable for injuries or death unless due to gross negligence.

8. Facility Rules 

  • 8.1 Booking Requirements: Members must pre-book training sessions online; walk-ins are not allowed.

  • 8.2 Behavior Standards: Physical violence, bullying, and inappropriate language are prohibited and may result in suspension or cancellation.

  • 8.3 Substance Use Policy: The use, possession, or entry under the influence of illegal substances, alcohol, or smoking is prohibited. Prescription medication exceptions require documentation.

  • 8.4 Use of Facility: Members must use the facility responsibly and respectfully.

  • 8.5 Inappropriate Conduct: Any inappropriate, disrespectful, or irresponsible use of the facility will result in a $50 fine.

  • 8.6 Examples of Violations: Includes but is not limited to causing disruptions, damaging property, engaging in unsafe activities, leaving rubbish, leaving gym equipment in unsafe and wrong places or disturbing other members' experiences.

9. Privacy & Photography

  • 9.1 Photo/Video Consent: By signing, members consent to be photographed or filmed for Lab use on various platforms.

  • 9.2 CCTV & Security Monitoring
    Basketball Lab facilities may be monitored by CCTV, access control systems and other security measures.  By entering the facility, members consent to the collection and use of CCTV footage, access records and security data for operational, disciplinary, investigative, debt recovery, security and legal purposes.  The Basketball Lab may use such records when investigating breaches of these Terms and Conditions.

  • 9.3 Law Enforcement Cooperation: The Lab may cooperate with authorities for investigation purposes.

10. Parent & Legal Guardian 

  • 10.1 If an adult enters the facility without a membership to supervise a member, it is strictly for supervision purposes only. The adult must not participate in any physical activity. Examples include, but are not limited to:

    • Rebounding

    • Playing one-on-one

    • Playing defense

    • Shooting

  • 10.2 If the supervising adult violates these rules:

    • The member’s account will be suspended.

    • A $150 fine for "theft of service" and “tailgating” will be charged to the member's account.

    • If the adult injures themselves while engaging in prohibited activities, they acknowledge they have acted contrary to these Terms and Conditions and release The Basketball Lab Pty Ltd and The Basketball Lab Underwood Pty Ltd from any claim to the maximum extent permitted by law.

  • 10.3 Underaged Member: Underaged members are not permitted to collect their access tag unless a parent or guardian is present at the facility. The parent or guardian will also be required to complete a Parental Guarantor Form. By signing this form, the parent or guardian accepts full responsibility for the membership contract and payment obligations, even if the underaged member completed the sign-up process. By signing, you confirm that the sign-up was completed with your consent, knowledge, and approval, and this document along with the Parental Guarantor Form serves as confirmation of that agreement.

11. Member Lounge Rules

  • 11.1 Restricted Access: Only members are permitted in the lounge. Sexual conduct or inappropriate behaviour may result in immediate cancellation and fines.

12. Debt Collection

  • 12.1 Overdue Payments: The Basketball Lab will notify you of overdue payments as frequently as it deems necessary.

  • 12.2 Third-Party Debt Collection: After 60 consecutive days of missed payments, the outstanding debt will be transferred to a third-party collection agency. By signing these terms and conditions, you consent to The Basketball Lab’s right to refer your debt to collections. At this point, your membership will be cancelled, incurring a $250 early cancellation fee (if applicable), along with a 30-day notice period charge, and $30 charge for replacing your access tag. 

  • 12.3 Responsibility for Fees: All additional fees and charges associated with debt collection will be your responsibility. You will not be permitted to rejoin The Basketball Lab until the remaining debt is paid in full.

  • 12.4 Cancellation 
    Cancellation of a membership does not remove any outstanding debt, fees, fines, charges or obligations owed to The Basketball Lab.

13. Damages

  • 13.1 Responsibility for Damages: Any and all damages caused by an individual using the facility will be the responsibility of the membership holder or guardian. By signing these terms and conditions, you consent to covering all costs associated with damages incurred.

14. Basketball Lab Training Sessions 

14.1 The Basketball Lab does not allow external coaching sessions. All sessions inside The Basketball Lab must be under the guidance of a coach authorized by The Basketball Lab. 
14.2 Bringing your own personal coach into the facility is considered theft of service and will be deemed tailgating.
14.3 Members cannot coach other members for financial gain. If this is performed, The Basketball Lab will seek any and all costs paid for the sessions.
14.4 Theft of service includes any attempt to access Basketball Lab facilities, coaching, equipment, membership benefits or services without the required membership, payment or approval from The Basketball Lab.

15. Facility Availability

15.1
The Basketball Lab reserves the right to restrict access to the facility or parts of it at any time for any reason, including but not limited to:

  • Events

  • Cleaning

  • Renovations

  • Maintenance

  • Repairs

You also acknowledge and consent that certain services, such as training sessions, shooting lanes, or court space, may occasionally be unavailable or may incur additional fees. Members are advised to check availability and pre-book services where applicable.

16. Parental Guardian Consent

This section applies if the membership is signed on behalf of a minor, or a minor has completed the sign up process themselves with your consent.

16.1 By signing these terms and conditions or parental guarantor form, you confirm that you are over the age of 18, you are either the legal parent or guardian of the membership holder, and take full responsibility for membership payments while agreeing to the following:

  • Payment Responsibility: You accept responsibility for all payments associated with the membership.

  • 24/7 Facility Access Consent: You give permission for the membership holder to access The Basketball Lab facilities 24/7.

  • Supervision Requirements:

    • Members aged 12 and under must always be supervised by you or another designated adult.

    • Members aged 13 to 16 may access the facility independently but may bring a parent or guardian for supervision purposes only, limited to providing guidance without participating.

16.2 By signing, you acknowledge and accept these responsibilities and confirm that you are aware of the supervision requirements based on the age of the membership holder.

16.3 You acknowledge that you were given adequate and sufficient time to review the terms and conditions before completing the sign-up process, whether done by you or someone else with your knowledge. By proceeding, you agree to all the terms and conditions outlined in the contract. If you chose not to review the terms and conditions, that is your own responsibility, and no one else is liable or accountable for this decision. 

17. Grandfathered & Legacy Membership Benefits

The Basketball Lab reserves the right to modify, replace or discontinue membership structures, pricing and benefits at any time.

Members who held a legacy membership prior to the introduction of new membership structures may retain their existing pricing and benefits under a grandfathered arrangement, provided:

  • Their membership remains active.

  • Their account remains in good standing.

  • Their membership is not cancelled or transferred.

Effective 1 August 2026, Basic, Bronze, Premium and Gold memberships are no longer available to new members.

Eligible grandfathered members may continue to receive their existing benefits, including Universal Access and other applicable inclusions.

The “Bring A Kid Free” benefit is only available to members who held an eligible Gold or Premium membership prior to 1 January 2026. The child must be 12 years of age or younger. Once the child turns 13, they must obtain their own membership to continue using the facility.

Grandfathered benefits are personal, non-transferable and may be removed if the membership is cancelled, terminated or otherwise becomes ineligible.

The Basketball Lab reserves the right to introduce new membership structures, pricing and benefits which may differ from grandfathered memberships.

18. Third-Party Provider Consent Form & Direct Debit Authorization

18.1 Third-Party Provider
The Basketball Lab works with third-party providers to deliver essential services to members. These services may charge a small transaction/processing fee. By signing these terms and conditions, you understand this and consent to the following:

  • Personal Information Storage: You authorize Perfect Gym, our gym management software provider, to securely store your personal information according to their data privacy policies.

  • Payment Processing: You give permission for Payrix, our payment processing provider, to withdraw membership payments from your nominated payment method as required under The Basketball Lab’s membership payment schedule and policies.

  • Direct Debit Authorization: You authorize The Basketball Lab to withdraw all applicable membership payments, fines, and other fees directly from your nominated personal payment method in accordance with The Basketball Lab’s policies.

18.2 Signature
Your signature on these terms confirms your consent to the use of these third-party services and the authorization of direct debit transactions as outlined above.

18.3 Electronic Acceptance

By signing these Terms and Conditions, ticking the Terms and Conditions acceptance box during the sign-up process, submitting a membership application, providing payment details, completing an online registration form or accessing Basketball Lab facilities, services or memberships, the member acknowledges and agrees that they have read, understood and accepted these Terms and Conditions and agree to be legally bound by them.

Electronic acceptance, digital acknowledgement, online acceptance and acceptance through a membership platform carry the same legal force and effect as a handwritten signature.

Where the membership holder is under eighteen (18) years of age, the parent or guardian acknowledges that they have reviewed these Terms and Conditions, consent to the membership and accept responsibility for all obligations, fees, charges and liabilities arising from the membership and will be required to sign a parental guarantor form.

18.4 Failure to Read
The member acknowledges that they have been provided adequate opportunity to review these Terms and Conditions prior to completing the sign-up process. Failure to read these Terms and Conditions does not remove any obligation arising under this agreement.
