Basketball Lab Academy Membership Terms & Conditions
1. Definitions
“Basketball Lab Academy Pty Ltd” / “Basketball Lab Academy” / “Lab Academy”
The contracting entity responsible for the delivery of programs, coaching services, billing, and membership administration under this Agreement.
“The Basketball Lab Pty Ltd” / “The Basketball Underwood Lab Pty Ltd” / “The Basketball Lab”
The parent company operating the facilities utilised by Basketball Lab Academy. The company who operates the 24/7 facility membership.
“Facility”
Any location used for training, including but not limited to West End, Underwood, or hired courts.
“Staff” / “Coaches”
All employees, contractors, or authorised representatives of The Basketball Lab and its subsidiaries (including Basketball Lab Academy).
“Participant”
The enrolled athlete receiving services.
“Parent / Guardian”
The person entering into this agreement on behalf of a participant (you) will hereinafter be referred to as the client.
2. Membership
2.1 Commitment Term
All memberships are billed weekly and are subject to a 12 week minimum commitment period.
2.2 Ongoing Membership
Memberships continue on a rolling basis until cancelled in accordance with these Terms & Conditions.
2.3 Contracting Party & Authority for Minors
Where the Participant is under eighteen (18) years of age, this Agreement is entered into solely between Basketball Lab Academy Pty Ltd and the Parent or Legal Guardian.
The Participant (minor) is not a contracting party to this Agreement.
By accepting these Terms, the Parent or Legal Guardian confirms they have full legal authority to act on behalf of the Participant and accepts full legal and financial responsibility for all obligations under this Agreement.
3. Billing Platform & Processing Fees
Basketball Lab Academy utilises CoachIQ and Stripe for billing and payments.
All payments are subject to a 2.9% processing fee, calculated on the total membership amount per transaction.
Processing fees are non-refundable under all circumstances.
4. Cancellation
4.1 Right to Cancel
You may request cancellation of your membership at any time.
All cancellations are subject to the requirements below, and billing will continue until those requirements are satisfied.
4.2 Cancellation Before the Second Month
If you cancel your membership before the start of the second month of membership, a $200 early exit fee will apply.
This fee is payable immediately and does not waive any outstanding fees already incurred.
4.3 Cancellation After the Start of the Second Month
If you cancel your membership after the start of the second month of membership, thirty (30) days’ written notice is required.
Billing will continue during the 30-day notice period.
4.4 Providing Cancellation Notice
All cancellation notices must be submitted in writing to: academy@thebasketballlab.net
No other form of notice will be accepted
The notice period begins only once the notice is received
A cancellation form may be required to complete the process
5. Cooling-Off Period
A 48-hour cooling-off period applies from the time of initial payment.
After this period, all fees become payable.
6. Direct Debit Authorisation
You authorise Basketball Lab Academy to debit payments weekly until cancellation requirements are met.
7. Attendance, Refunds & No Guarantees
Attendance is your responsibility.
No refunds or credits are provided for missed sessions.
Basketball Lab Academy makes no guarantees regarding improvement, performance, or outcomes.
Sessions do not roll over and expire at the end of each week.
Membership fees are charged on a weekly basis, not per session. If you attend fewer sessions than allowed on your membership type, or do not attend any sessions in a given week, the membership fee remains unchanged and no refunds or credits will be issued.
Your membership provides access to sessions each week; attendance is the participant’s responsibility.
8. Pauses
▪ One (1) pause of up to two (2) weeks per commitment period is permitted
▪ Pauses extend the commitment term by the amount paused
▪ Additional pauses require a medical certificate unless otherwise agreed upon by Basketball Lab
▪ Academy in writing on a specific case by case basis
▪ Program pauses due to holidays, facility issues, or events outside Basketball Lab Academy’s control extend the commitment
8.5 Injury Notification & Retroactive Claims
Basketball Lab Academy cannot assess injuries unless notified.
Failure to notify Lab Academy at the time of injury will result in billing continuing as normal.
Pauses, refunds, or credits will not be applied retrospectively.
Fees for missed periods remain payable and will not be refunded.
9. Coaching & Scheduling
Sessions may be rescheduled due to coach availability or operational needs.
Cancelled booked sessions by Basketball Lab Academy receive one (1) session credit.
No credit applies if not booked.
10. Player Placement
Players may be moved between training groups based on development and safety needs.
This is a performance-focused program, not a recreational service.
11. Behaviour & Termination
Unsafe or disruptive behaviour may result in immediate suspension or termination.
Outstanding fees remain payable.
12. Booking Policy
Sessions must be booked in advance.
A $10 no-show fee applies to missed booked sessions.
This fee will be charged to your payment method on file.
13. Media Consent
You consent to the use of photos and videos (which may include you or the participant) for marketing and education.
14. Facility Conduct
Facility access outside Academy sessions requires an active Basketball Lab Facility Membership.
Children must be supervised at all times.
15. Liability Waiver & Risk
Participation involves inherent risks.
You release Basketball Lab Academy Pty Ltd, The Basketball Lab Pty Ltd, The Basketball Lab Underwood Pty Ltd and staff from liability to the fullest extent permitted by law.
16. Suspension of Access
Access may be suspended for overdue payments without suspending billing obligations.
17. Chargebacks & Disputes
Disputed or reversed payments remain payable, including associated fees.
18. Force Majeure
Basketball Lab Academy is not liable for events beyond its control, including government restrictions or facility closures.
19. Debt Collection
Accounts 60 days overdue will be referred to debt collection.
Default cancellations will incur additional fees and collection action. This is when a contract is 60 days overdue outside the minimum commitment period and we have not received cancellation notice from the client. The outstanding plus 30 days notice will be referred to debt collection.
20. Privacy & Data Handling
You consent to the use of personal data for administration, analytics and billing via third-party platforms.
21. Amendments
These Terms may be amended with notice.
Failure to respond within seven (7) business days constitutes acceptance.
22. Third Party Authorisation
By agreeing to these Terms and Conditions, you authorise The Basketball Lab Pty Ltd, The Basketball Lab Underwood Pty Ltd, and Basketball Lab Academy Pty Ltd to engage and use third-party service providers as required to deliver and manage services. This includes, but is not limited to, direct debit and payment processing, processing and transaction fees, debt collection, data storage, booking and scheduling systems, access control, and administrative services. You consent to your personal and payment information being shared with and stored by these third-party providers strictly for these purposes and in accordance with applicable privacy and data protection laws.
23. Facility Membership Add On
The Facility Membership is governed by The Basketball Lab Pty Ltd and The Basketball Lab Underwood Pty Ltd.
We offer a one-time Facility Membership add-on, which is available only at the time of signing up for the Basketball Lab Academy. This add-on is $50 per week and operates on a non lock-in contract.
If you choose to opt into the Facility Membership add-on, it is bundled with and directly linked to your Basketball Lab Academy membership. This means facility access under this add-on is only available while you are actively enrolled in the Academy.
Once your Basketball Lab Academy membership ends, the Facility Membership add-on automatically ends as well. The add-on cannot be continued independently at the $50 per week rate once you are no longer in the Academy.
If you wish to continue using the facility after leaving the Academy, you will need to join under a standard Facility Membership, selecting a 6, 12, or 18-month commitment option.
If the Academy Membership is cancelled, the Facility Membership is also cancelled.
If an Academy Membership is frozen, the Facility Membership is also frozen.
All cancellations of the Facility Membership are subject to the Basketball Lab Academy Membership cancellation process and applicable cancellation fees.
While the memberships are administered by separate entities, all actions relating to cancellation, freezes, access, and eligibility apply to both memberships at the same time.
24. Direct Debit Authorisation (Backup Payment Method)
As part of this agreement, Members are required to provide bank account details as a backup payment method in the event that the primary payment method used through Stripe & Coach IQ (e.g. card payment) fails or defaults.
Authorisation & Consent
By providing the bank details and signing below, you confirm:
▪ Authorises Basketball Lab Academy Pty Ltd to debit the nominated bank account for fees payable under this agreement if payment by the primary method fails.
▪ Confirms they are the account holder or an authorised signatory on the nominated account.
▪ Acknowledges that debits will occur on a weekly basis in line with the membership billing schedule.
Fees
The Member acknowledges and agrees that:
▪ All direct debits include a 2.9% processing fee to cover payment processing costs through Stripe and CoachIQ, as outlined in this document.
▪ The membership fee payable will depend on the membership option selected by the Member, as set out in this agreement and subject to its terms.
Signature
This direct debit authorisation forms part of the acceptance of the Terms & Conditions and remains valid until the membership is cancelled in accordance with the cancellation terms.
25. Final Agreement
By accepting these Terms, You confirm that You:
▪ Understand and accept all Terms & Conditions
▪ Accept full legal and financial responsibility
▪ Confirm you have the financial capacity to meet all payment obligations
▪ Agree to make payments in full and on time
▪ Acknowledge that failure to read these Terms does not exempt you
▪ Authorise direct debit billing and processing fees
Basketball Lab Academy Free Trial Terms & Conditions
By participating in a Basketball Lab Academy Free Trial Session, you acknowledge and agree to the following Terms & Conditions.
1. Free Trial Eligibility & Validity
▪ Each participant is eligible for one (1) free trial session only.
▪ The free trial session credit is valid for seven (7) days from the date it is issued.
▪ If the free trial session is not used within seven (7) days, it expires automatically and cannot be extended, reissued, or redeemed.
▪ Once the free trial session has been used, the participant is no longer permitted to attend any sessions unless they have an active paid membership.
2. Membership Requirement
▪ The free trial is offered solely as an introduction to the Basketball Lab Academy.
▪ Continued participation in Academy sessions requires an active membership.
▪ Participants who wish to continue training after their free trial must sign up for a membership prior to attending any further sessions.
3. Assumption of Risk
Participation in basketball training, strength training, conditioning, and related activities involves inherent risks, including but not limited to:
▪ Physical injury
▪ Serious bodily harm
▪ Permanent disability
▪ Death
By participating in the free trial, you voluntarily assume all risks, whether known or unknown, associated with training at Basketball Lab Academy.
4. Waiver & Release of Liability
To the fullest extent permitted by law, you hereby release, waive, discharge, and hold harmless:
▪ Basketball Lab Academy Pty Ltd
▪ The Basketball Lab Underwood Pty Ltd
▪ Basketball Lab Pty Ltd
▪ All directors, officers, employees, contractors, coaches, staff, and affiliates
from any and all claims, demands, liabilities, actions, damages, costs, or expenses, including but not limited to those arising from:
▪ Personal injury
▪ Illness
▪ Property damage
▪ Loss
▪ Disability
▪ Death
whether caused by negligence or otherwise, arising from or related to participation in the free trial session or presence at any Basketball Lab facility.
5. Medical Responsibility
▪ You confirm that you are physically fit and medically able to participate in training activities.
▪ You are solely responsible for consulting a medical professional before participating if you have any health concerns, injuries, or medical conditions.
▪ Basketball Lab Academy does not provide medical advice, diagnosis, or treatment.
6. Minors
▪ Participants under the age of 18 must have this agreement accepted by a parent or legal guardian.
▪ By allowing a minor to participate, the parent/guardian agrees to all terms on behalf of the minor.
7. Acceptance of Terms
▪ By booking, attending, or participating in a free trial session, you confirm that you have read, understood, and agreed to these Terms & Conditions.
▪ These Terms & Conditions are binding and apply for the duration of the free trial period.
